Terms of Use

1. Who we are and what we offer

Marca na Tela (“Marca na Tela”, the “platform”, “we”), operated by Bly Mídia, is a self-service indoor media platform that lets the venue (“you”, the “Client”) personalize and organize the display of content on its own screens — such as ads, promotions, notices, badges, footer bars and videos. These Terms govern the use of the platform (website, web dashboard and desktop application). By creating an account or using the service, you declare that you have read, understood and agree to them.

2. What the platform does — and does not do

Marca na Tela is only a tool for personalizing and organizing the display. We do not produce, license, select, nor are we the source of the main content that appears on your screens (for example: TV channels, sports broadcasts, films, soap operas, music, YouTube videos or those of any third party). That content is chosen, provided and controlled by you.

3. Displayed content and third-party rights

You are the sole and exclusive party responsible for all content displayed on your screens, including ads, images, texts, videos, audio and any broadcasts reproduced in your environment.

By using Marca na Tela, you represent and warrant that:

• you hold all the rights, licenses and authorizations necessary to display the content, including copyright and related rights, image rights and trademark rights;
• you have obtained, where required, the public performance licenses and third-party authorizations — for example, from ECAD (for music), broadcasters and holders of broadcasting rights (for games, programs and channels);
• the content does not violate any laws, third-party rights or these Terms.

Marca na Tela is not responsible for the content displayed on your screens nor for any copyright, related rights or image rights that may exist in the third-party broadcasts reproduced in your venue. The platform merely personalizes and organizes that display. Obtaining and maintaining the licenses and authorizations is the Client's sole responsibility.

You agree to hold harmless and indemnify Marca na Tela and Bly Mídia against any claim, notice, fine, loss, damage or expense (including legal fees) arising from the content displayed on your screens or from the lack of the necessary authorizations.

4. Your account

You are responsible for keeping your password confidential and for all activity on your account. Keep your registration details accurate and up to date. Notify us immediately if you suspect any unauthorized use.

5. Plan and billing

Access is currently free, complete, at no charge and with no set trial period. Should we begin charging for your use, this will be communicated and agreed with you in advance — there is no automatic charge without your consent.

6. Acceptable use

You agree not to use the platform to:

• display or distribute unlawful, offensive, discriminatory or misleading content;
• violate third-party rights (copyright, image, trademark, among others);
• attempt to bypass technical limits, access third-party accounts or harm the operation of the service.

7. Availability

We strive to keep the platform stable and available, but it is provided “as is”. Maintenance, updates, instabilities or interruptions may occur, and we do not guarantee uninterrupted or error-free operation.

8. Limitation of liability

To the maximum extent permitted by law, Marca na Tela and Bly Mídia shall not be liable for indirect damages, loss of profits, loss of revenue or data, nor for losses arising from the content displayed, the use or the unavailability of the service. Any liability is limited to the amounts actually paid by you in the 12 months prior to the event (which may be zero on the free plan).

9. Suspension and cancellation

You may stop using the platform at any time. We may suspend or terminate accounts that violate these Terms or the law, or that pose a risk to the platform or to third parties.

10. Privacy

The processing of your personal data is described in our Privacy Policy, which forms part of these Terms.

11. Changes to these Terms

We may update these Terms to reflect changes in the service or in the law. When a change is significant, we will notify you through the contact channels or within the service itself. Continued use after the update means acceptance of the new version.

12. Governing law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of Fernandópolis - SP are elected to settle any disputes, without prejudice to the applicable consumer protection rules.
